Terms of Service

These Terms of Service ("Terms") govern your use of the appointment alert service (the "Service") provided by Appointment Scout, a DBA of Secoya Integrated Solutions, LLC ("Appointment Scout," "we," "us," or "our"). By using the Service, you agree to these Terms.
The Service
Appointment Scout monitors publicly available government and third-party appointment scheduling systems and sends you SMS text message alerts when appointments matching your selected preferences become available. We are an independent service and are not affiliated with, endorsed by, or sponsored by any Department of Motor Vehicles, government agency, or third party whose appointment availability we monitor.
No Guarantee of Availability
We do not control appointment inventory and cannot guarantee that any appointment will be available, that an alert will result in a successful booking, or that alerts will be delivered without delay. Appointment availability changes rapidly and outside of our control. The Service is provided on a best-effort basis.
SMS Text Messaging Program
By enrolling and providing your mobile phone number, you consent to receive recurring automated SMS text message alerts from Appointment Scout.
- Program description: Appointment availability alerts based on the preferences you select.
- Message frequency: Message frequency varies and depends on appointment activity matching your preferences.
- Cost: Message and data rates may apply, according to your mobile carrier plan.
- Opt out: Reply STOP to any message to cancel at any time. After you send STOP, we will send one confirmation message and then stop sending SMS messages.
- Help: Reply HELP for assistance, or contact us at support@apptscout.com.
- Carriers: Carriers are not liable for delayed or undelivered messages.
Consent to receive SMS messages is not required as a condition of purchasing any goods or services.
Eligibility
You must be at least 18 years old and the authorized user or owner of the mobile phone number you provide. You agree to provide accurate information and to keep it current.
Payment
Access to the Service requires a one-time payment. The price and what it covers (currently a 30-day period of appointment alerts) are presented at the point of purchase. Payments are processed by a third-party payment processor. The purchase is one-time and does not automatically renew; your access ends when the purchased period expires unless you choose to make another purchase.
Acceptable Use
You agree not to misuse the Service, including by attempting to interfere with its operation, reselling alerts without authorization, or using the Service for any unlawful purpose.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Appointment Scout and Secoya Integrated Solutions, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any missed appointments, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
Changes to the Service and Terms
We may modify or discontinue the Service, and we may update these Terms, at any time. When we update these Terms, we will revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles.
